Dear Upland Residents,

I want to take a moment to provide an important update regarding the repeal of Ordinance 1557 and what it means for our community moving forward.

To begin, it is important to acknowledge that there were several challenges with the ordinance itself. While it provided certain protections, it also contained provisions that were outdated or difficult to implement in practice. For example, the requirement for a homeowners association structure was not enforceable, and portions of the ordinance were no longer fully aligned with current state law. These issues made it clear that updates were necessary to ensure the ordinance remained both effective and legally compliant.

In 2025, the City Council repealed Ordinance 1557 in its entirety as part of a broader omnibus update to the Municipal Code. These types of updates are a common and routine process used by cities to clean up outdated language and ensure local laws remain consistent with current state regulations.

However, in this case, the outcome did not fully reflect the original intent. The goal was to update and modernize the ordinance so that it aligned with current law and economic conditions. Instead, the ordinance was removed in its entirety. The staff report reflected this as a full removal, rather than showing a redlined version of proposed changes, which was the method used for other sections included in that same update.

While it is clear that Ordinance 1557 needed to be revised, its complete removal has had broader impacts than anticipated. This ordinance directly affected housing costs, property values, and financial stability for many residents and property owners. Changes of this magnitude require a thoughtful and transparent process, including public engagement and clear communication, so that everyone impacted has the opportunity to understand and provide input.

Recognizing the importance of this issue, the City Council will be bringing this item forward at our first meeting in May. This will allow for an open discussion about the impacts of the repeal and provide direction to staff on how to move forward. The goal is to identify a path toward restoring a balanced and updated framework that reflects today’s legal standards while also protecting our community.

This is about taking responsibility, correcting course, and adopting an ordinance that provides fair and equitable standards for all parties involved. I remain committed to working with my colleagues, staff, and the community to move forward in a way that is thoughtful, fair, and responsive to the needs of Upland.
